Application Materials for State Stormwater Discharge Permit Applications

The Vermont Stormwater Management Program is announcing several major changes to its Operational (i.e. non-construction) Stormwater Discharge Application process for projects seeking coverage under General Permit 3-9015, and for those projects seeking coverage under an Individual Stormwater Discharge Permit.   These changes have been discussed with a number of consultants and with representatives of ACEC over the past year.

As you will read in the new "Application Instructions for State Stormwater Discharge Permits", we have extensively revised the 3-9015 Notice of Intent (NOI), the Individual Stormwater Discharge Permit Application form and the associated Schedule A's, as well as developed "worksheets" for stormwater treatment practices (STPs) , waivers, and credits.  While the new forms will require more information than our previous forms, they serve to consolidate information regarding required design elements that previously was provided in the application narrative.  They will also provide additional technical guidance in areas of the VSWMM where problems were frequently noticed in reviewing applications. 

An important associated change to the application process will be the introduction of a complete screening of applications prior to their initial acceptance by the Program.  Incomplete or erroneous applications will be rejected, and will be returned with a checklist of deficiencies.   This change is necessary because it has become evident that an increasingly inordinate amount of time is currently being spent by our limited staff in back-and-forth discussions with consultants in an effort to correctly complete sub-standard applications.  Unfortunately this effort comes at the expense of increased processing time for those applications that are both administratively and technically complete.  Implementation of these new and comprehensive forms, coupled with the initial application screening should lead to greatly reduced permit processing times, as well as the creation of a new "express lane" for relatively simple projects that employ standard practices for treatment and control. 

In summary, implementation of these changes will serve as a major step towards increased reliance on the certification by stormwater designers in our review of applications, and therefore significantly decreased application review times.

Please be aware that the new forms will be required for all applications received by the Stormwater Program after June 15, 2006. 

 

 

Instructions for use:

All of the application forms must be downloaded, while the "worksheets" can be downloaded as necessary depending on your project and which STP, waiver and credit you might be employing for each discharge point.  Essentially, the Schedule A summarizes how compliance with the 5 stormwater criteria has been achieved for each discharge point.  As has always been the case, the designer will indicate on the Schedule A how she/he has achieved compliance with each of the stormwater criteria, either through the use of an STP, a waiver, a credit, or some combination of the three.  Now, however, each STP, waiver or credit will also have a required worksheet and, in some cases, accompanying guidance which will help the designer demonstrate that she/he has complied with all of the required elements in the VSWMM. 

An application will not be considered administratively complete, will not proceed on to technical review and will be returned to the designer (and the applicant copied) unless all of the items listed on the NOI form and on the narrative checklist are provided, and all of the required worksheets for any STP, waiver or credit listed on the schedule A's for a project are completed and included with the submission.

The completion of these worksheets does not automatically constitute compliance with the 2002 VSWMM, and when in doubt, designers should review the 2002 VSWMM for verification of standards, treatment practices, waivers or credits or contact the Stormwater Section at 802-241-4320.
